The Manpower Substance in the Job Creation Law Needs Improvement
The government plans to follow up on the decision of the Constitutional Court regarding Law Number 11 of 2022 concerning Job Creation by prioritizing reforming the formal aspects of the regulation.
Commission IX of the DPR reminded the government to make substantial revisions, in particular to fix a number of labor substances that harm workers. This was stated in a working meeting between Commission IX of the DPR with the Minister of Manpower Ida Fauziyah and other officials from the Ministry of Manpower at the Parliament Complex, Senayan, Jakarta, Monday (24/1/2022). Ida Fauziyah explained the government's plan to follow up on the Constitutional Court's decision, which stated that the Law on Job Creation was conditionally unconstitutional. According to Ida, improvements to the formal aspects of the Job Creation Law will be prioritized by revising Law No. 12/2011 on the Regulations for the Establishment of Legislation (PPP). “This Constitutional Court's decision looks more at the formal flaw in the Job Creation Law, that the omnibus law drafting method is not standard in the formation of legislation. Because this is considered a formal defect, the follow-up action is to revise the PPP Law," said Ida in her presentation. The revision of the PPP Law will be carried out under the coordination of the Ministry of Law and Human Rights (Kemenkumham) with the Legislative Body of the DPR. "We will be involved in time, but because this is more a matter for the Ministry of Law and Human Rights, then the Ministry of Law and Human Rights will represent the government in the formulation of the revision," said Ida.
